CMS Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting (CMS 3442-P)

Good morning colleagues, 

I hope that this email finds you well. You may already be aware; however, I wanted to ensure that you receive the attached information.  

CMS has released a proposed rule on nurse staffing, specific to nursing homes. Although there have been requests from other facility types, at this time the CMS proposed rule only focuses on nursing homes and consists of three core staffing proposals: 

1) minimum nurse staffing standards of 0.55 hours per resident day (HPRD) for Registered Nurses (RNs) and 2.45 HPRD for Nurse Aides (NAs); 

2) a requirement to have an RN onsite 24 hours a day, seven days a week; and 

3) enhanced facility assessment requirements 

There will be a 60-day comment period for the notice of proposed rulemaking, and comments must be submitted to the Federal Register no later than November 6, 2023. Please review and share among your networks, members, and/or member organizations, as appropriate. CMS is looking for robust comments on the rule given the landmark implications. It is my hope that the nursing community leverages our collective voices to identify areas for CMS to consider.
